When a school becomes an academy, the land is transferred from the local authority to the academy’s trust, usually through a 125 year lease.
However, councils sometimes do not understand how the land should be treated during the conversion process and are not always quick in their response to the needs of schools looking to achieve academy status.
While the Secretary of State already has the power to make a scheme to transfer local authority land to an academy, the government has launched a consultation to establish the precise information he requires in order to take such action.
The proposed regulations will ensure that the Secretary of State receives all the relevant documents and information when he requests them, so that transfers can take place more quickly and easily.
Local authorities have until 18th January 2012 to respond to the proposals. In the meantime, any academies which require help with land transfers or any other issues should contact us.
