If you have young children, you need to make arrangements in your will for their ongoing care in the event of your death. As well as naming a guardian, this may involve setting up a trust to provide for the children while they are minors.

For example, a trust may be created to cover a child’s education and general living expenses, with any remaining income added to the trust property until the children reach the age at which they are able to benefit from the trust, the terms of which will specify how they do so.

If you have a disabled child, a disabled discretionary trust is a useful vehicle to make long-term arrangements for their financial security.

By using your will to place assets in a trust in which the child is a beneficiary, these assets will be excluded from assessing entitlement to state benefits or help towards the funding of care. You can also use your will to name the trustees to operate the trust, who will control how the assets are used.
