Farmer fined £89,000 for neglecting his environmental responsibilities
By Chris Wright, Consultant and ARA specialist
A farmer from Cornwall has been handed a fine totalling £89,000 for running an illegal waste site on his farm, which saw numerous hazardous waste materials dumped on his land.
Over 10,000 tonnes of waste material, which included asbestos, was dumped on the farmer’s land. Having ignored the Environment Agency’s (EA) warnings, he will need to pay an initial £72,500 fine plus the full prosecution costs of £16,653.99.
The case is an important reminder for all farmers about the importance of following their legal obligations to the environment, ensuring they have effective measures in place.
What charges were brought against the farmer?
The farmer faced two charges in court. The first was for running a regulated waste operation facility that included the deposit and storage of hazardous waste materials on his land to an extent beyond an environmental permit.
The other charge brought forward by the EA was the disposal of hazardous waste materials containing asbestos in a way that would cause significant pollution damage to harm the environment and threaten life.
The farmer wanted to generate more income and had planned to build a shooting range, but once he suggested there was an opportunity to dump waste on his land, many did just that.
The consequences of the farmer’s actions have caused serious damage to the land and the environment around it. The actions of the farmer highlight how important it is not to neglect your legal obligations because you will face the music if you fail.
The importance of farmers meeting their obligations to the environment
Farmers have strict obligations to meet to ensure the environment is safe and protected.
You must protect all environmental areas, including preserving the quality of water, soil, air, habitats, as well as trees and woodland areas on your land and dispose of any waste ethically and safely.
Because there are so many regulators, you need to know your obligations and factor those into any expansion and farm maintenance plans moving forward.
As proven above, the consequences of not meeting your environmental obligations can be disastrous for both you and your farm.
You need to have effective plans in place to ensure you meet the demands and have the funds to improve your facilities if required.
